JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Pupri P.S. Case No. 03 of 2012 registered under Section 379 of the Indian Penal Code and Section 40 of the Bihar Mineral Act. Learned counsel for the petitioner submits that, in fact, petitioner is not running the brick-kiln and in this regard the Mukhiya of the village has issued certificate to the effect that no brick-kiln was run by the petitioner, which would appear from Annexure 2 of the application. Learned counsel for the petitioner further submits that co-accused, Mustafa Khan, has already been granted privilege of anticipatory bail by a Bench of this Court vide order dated 08.03.2013 passed in Criminal Misc. No. 5758 of

Patna High Court Cr.Misc. No.47707 of 2014 (2) dt.30-04-2015 2013.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Pupri at Sitamrhi in connection with Pupri P.S. Case No. 03 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
