JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 307, 379, 324, 323, 341, 447, 504, 147, 148 and 149 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner nos. 4 and 5 are ladies and all the five petitioners belong to the same family.
Learned senior counsel, appearing on behalf of the petitioners, has submitted that there is no specific allegation against these petitioners. He has further submitted that other similarly situated co-accused persons, namely, Bichhu Yadav,
Patna High Court Cr.Misc. No.51422 of 2014 (2) dt.30-04-2015 2/2 Dinesh Yadav, Nitish Yadav @ Nitish Kumar and Lalan Yadav, have already been granted the privilege of anticipatory bail vide order dated 31.07.2014 passed in Cr. Misc. No. 31980 of 2014 by another Bench of this Court. In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of Sri A. Kumar, Judicial Magistrate, Ist Class, Saharsa, in connection with Saur Bazar P.S. Case No. 132 of 2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
