Petitioners apprehend their arrest in connection with Trial No. 3803 of 2017, arising out of Nautan (Jagdishpur) P.S.Case No. 332 of 2016 registered for the offences punishable under Sections 420, 406, 467, 468 and 471/34 of the Indian Penal Code. Allegation against the petitioners is that co-accused Dinesh Kumar Pandey in conspiracy with the petitioners prepared a forged Panchnama in the name of informant.
Submission of learned counsel for the petitioners is that the petitioners are witnesses to the said Panchnama and final form in this case has been submitted by police as mistaken of facts and in other case lodged by the informant for the same occurrence
Patna High Court Cr.Misc. No.39896 of 2018 (2) dt.10-07-2018 2/2 petitioners were granted privilege of anticipatory bail. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI-cum-Sub-Judge-III, West Champaran, Bettiah, in connection with Trial No. 3803 of 2017, arising out of Nautan (Jagdishpur) P.S.Case No. 332 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
