JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 28-06-2018 In case, there is encroachment by the private respondents on the Government land and the statutory authority have not taken any action in the matter, the petitioner may file a certified copy of this order along with relevant documents before the statutory authority, namely, Circle Officer, and the Circle Officer shall proceed to remove the encroachments after hearing all concerned in accordance with law. The statutory authority under the Bihar Public Land Encroachment Act shall take action with regard to the issue in question, if not already taken, preferably within a period of six months from the date of receipt of the certified copy of this order.

Needless to emphasise, we have not expressed any opinion on the merits of the allegations made and the statutory authority shall proceed in the matter in accordance with law, hear all concerned and thereafter, pass appropriate orders.
