JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act.
From the house of Indradeo Singh 5 Kgs. Ganja were recovered. The villagers suggested that petitioner in league with co-accused Indradeo Singh used to do trafficking of the contraband.
It is submitted by the learned counsel for the petitioner that admittedly no recovery has been made from the petitioner. Though, the petitioner was made accused in Gandhi Maidan P.S. case No. 483 of 2013 with similar accusation but in that case he has been granted bail by a coordinate bench of this court vide
Patna High Court Cr.Misc. No.19897 of 2016 (2) dt.04-05-2016 2/3 order passed in Cr. Misc. No. 5377 of 2016.
Considering the fact that recovery of contraband is made from the house of Indradeo Singh and petitioner was not present there, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur, Ara in connection with Behea P.S. Case No. 143 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioners will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The learned court below will get the said affidavit transmitted to the concerned I.O. Non cooperation in the investigation will give liberty to the learned court below to cancel bail bonds of the petitioner.
