JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sadar P.S. Case No. 290 of 2019 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a) and 38(ii) of Bihar Prohibition and Excise Act.
Allegation is of recovery of huge quantity of liquor from the house of the petitioner.
Submission of learned counsel for the petitioner is that nobody is residing in that house and petitioner was residing at Delhi and in support of the same he has document that he was residing at Delhi.
Heard learned APP, who has opposed the prayer for anticipatory bail stating that recovery of huge quantity of liquor
Patna High Court CR. MISC. No.52319 of 2019(2) dt.22-08-2019 2/2 has been made from the house of the petitioner. In view of above facts and circumstances, let petitioner surrender and pray for regular bail and produce any document showing that he is residing at Delhi, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
