====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

3. Prosecution case, in brief, is that daughter of the informant was married with Sushil Paswan in July, 2018. Daughter of the informant was living with the accused persons while her husband was working in Jharkhand. It is alleged that

Patna High Court CR. MISC. No.55671 of 2023(2) dt.29-08-2023 2/2 daughter of the informant told him that all the accused persons scuffled with her and pressurized her for dowry. On 11.02.2023, informant got information that her daughter was killed by the accused persons by pressing her neck.

4. Learned counsel for the petitioners submits that informant is not an eye witness of the occurrence and only on suspicion these petitioners have been made accused in the present case. At the relevant time, petitioners were not present at the place of occurrence and no specific allegation has been made against all the accused persons.

5. Learned A.P.P. for the State opposes the bail application and submits that petitioners are named in the F.I.R. and there is specific and direct allegation that these petitioners committed murder of the daughter of the informant by pressing her neck. Moreover, the post-mortem report attached with the case diary also shows that cause of death is Asphyxia and hanging.

5. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioners is refused. (Prabhat Kumar Singh, J) Navya/- U T
