Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 68284 of 2019, which was rejected vide order dated 04.12.2019 (Annexure-1).

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner has no criminal antecedent. Petitioner is in rotting in judicial custody since 26.06.2019 i.e. for more than two years and there is no progress in the trial. The report called for from the court below with regard to the stage of trial has been received and is kept at Flag-A. Perusal of the report shows that the trial is almost at

Patna High Court CR. MISC. No.10887 of 2021(4) dt.29-09-2021 2/2 its initial stage and is pending for appearance of accused. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 238 of 2019.
