ANJANA MISHRA ORAL ORDER 02-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Special Case No.1 of 2014, arising out of Bikram P.S. Case No.7 of 2014, registered for the offence under Sections 366A, 372/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

Case diary in the present case was called for, which has since been received.

After hearing the learned counsel for the petitioner and the learned counsel for the State and on perusal of the materials available in the case diary and the statement of the

Patna High Court Cr.Misc. No.20102 of 2016 (3) dt.02-08-2016 2/2 victim girl recorded under Section 164 Cr.P.C., it appears that the girl was not recovered from the house of the present petitioner. It is further submitted by the learned counsel for the petitioner that two other co-accused, i.e., wife of Buti Nut and Mausi of the petitioner, who sold the victim girl, have been extended the privilege of regular bail by the court below. Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Patna, in connection with Special Case No.1 of 2014, arising out of Bikram P.S. Case No.7 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
