JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 504/34 of the Indian Penal Code.

The prosecution case is that the petitioners along with Jhunnu Paswan came and started abusing the informant when protest was made then co accused Jhunnu Paswan assaulted him with fists and slaps. When the nearby people came to rescue co accused Jhunnu Paswan assaulted on the head of the informant with bricks as a result the informant fell down and became unconscious.

No.17313 of 2016 (3) dt.26-04-2016 2/2 It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against the petitioners and others when the specific accusation of causing injury with bricks on the head of informant is against co accused Jhunnu Paswan. The injury report of the informant reflects swelling on occipital region.

Considering the specific accusation against co accused Jhunnu Paswan, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town P.S. Case No. 525 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
