JUSTICE ARUN KUMAR ORAL ORDER 13-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Narpatganj P.S.Case No. 71 of 2018 registered under Sections 307, 353, 399 and 402 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that petitioner was apprehended along with other miscreants said to have been making plan for committing dacoity and one country made pistol with one fire cartridge was recovered from his possession.

Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as other co-accused Md. Shamshad @ Munna Mian, having criminal antecedent, from whose possession also there is recovery of arms, was granted bail in this case by a co-ordinate Bench of this Court vide Cr.

Patna High Court Cr.Misc. No.42274 of 2018(2) dt.13-07-2018 2/2 Misc. No. 38741 of 2018 and the petitioner has remained in custody for more than five months.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Madhav Yadav @ Madho Yadav @ Madhav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Narpatganj P.S. Case No. 71 of 2018.
