JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-04-2022 Heard Mr. Chandra Kant, the learned counsel for the petitioners and the learned APP for the State. At the outset, the learned counsel for the petitioners seeks permission to withdraw the petition with respect to petitioner no. 1, who has been arrested.

The petition with respect to petitioner no. 1/ is dismissed as having become infructuous.

The petitioner no. 2 seeks bail in anticipation of her arrest in connection with Guthni P.S. Case No. 181 of 2019 instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.8468 of 2021(6) dt.18-04-2022 2/2 that though petitioner no. 2 has been made accused in this case but the accusation is absolutely general and omnibus. There is no specific accusation against her.

The petitioner no. 2 along with her husband resided separately from the deceased and her husband. Though, the husband of the deceased is not to be traced till date but so far as the petitioner no. 2 is concerned, she has got no control over the affairs of the husband of the deceased and she is a house lady with no specific accusation against her.

Considering the afore-noted arguments and taking into account that her husband has now been taken in to custody, the provisional bail granted to the petitioner no. 2 by order dated 20.12.2021 is hereby confirmed.

The petitioner no. 2 shall remain on the same bail bonds.
