The petitioner seeks anticipatory bail in connection with POCSO Case No. 16 of 2018, arising out of Pakaribrawan P.S. Case No. 74 of 2018, G.R. No. 1245 of 2018, registered for offences punishable under Sections 341, 323, 354, 354D of the Indian Penal Code and 8 POCSO Act.

Allegation against the petitioner is that he is named in the FIR and misbehaved with the informant and forcibly snatched her mobile from her pocket of jeans and outrages her modesty. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the dispute is going on between the petitioner and the victim girl. Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders before the court below within a period of six weeks from the date of the order, he will be released on provisional bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-1st cum Special Judge, Nawada, in connection with POCSO Case No. 16 of 2018, arising out of Pakribrawan P.S. Case No. 74 of 2018, G.R. No. 1245 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
