The petitioners seek bail in Khodaganj P.S. Case No. 70 of 2017 registered for the offence punishable under Sections 302, 201, 120B/34 of the Indian Penal Code. Allegation against the petitioners is of committing murder of the father of the informant.

It has been submitted on behalf of the petitioners that the petitioners are innocent and have been falsely implicated in this case due to land dispute. It has been further submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 26.06.2018 passed in Criminal Miscellaneous No. 17187 of 2018.

Patna High Court Cr.Misc. No.40165 of 2018(2) dt.12-07-2018 2/2 Petitioners have got no criminal antecedent and are in custody since 13.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Hilsa, Nalanda in connection with Khodaganj P.S. Case No. 70 of 2017.
