The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 290, 291, 332, 353, 384 and 427 of the Indian Penal Code. It is alleged that 20 First Information Report named accused persons and others were demanding extortion money from the truck driver, when the informant being the Police Officer persuaded the accused persons not to make extortion then they pelted bricks, as a result the armed party received injury on the vehicle.
It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general in nature. No injury was caused to any police personnel. Statement has been made in para-3 of the petition that
Patna High Court Cr.Misc. No.6569 of 2015 (2) dt.19-02-2015 petitioner has no criminal antecedent and the co-accused have been granted anticipatory bail.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 38 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
