ANJANA MISHRA ORAL ORDER 29-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Pandaul P.S. Case No. 21 of 2016 for the offences registered under Sections 506, 341, 323, 325, 379, 504 and 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is case and counter case between the parties. It is further submitted that there is history of litigation between the informant and the present petitioner on account of the fact that another case was lodged by the petitioner for having indulged in such activities, in which the niece of the informant was involved. It is further submitted that though the allegation against the petitioner is that he had attacked the informant but the injury purported to have been inflicted upon the informant has been found to be simple in

Considering the nature of allegation made against the petitioner and the history of litigation between the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 21 of 2016 corresponding to G.R. No. 242 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
