The petitioner, already in custody, seeks bail in connection with Sarairanjan P.S.Case No. 181 of 2017 registered under Sections 120B, 201 and 302 of the Indian penal Code.

Allegation in brief is that on hearing gun shot, complainant reached there and found the petitioner running away with pistol in hand and also found her son injured by firearm.

Submission is that deceased is own nephew of the petitioner and this case was instituted three months after the occurrence for some extraneous reason for seeking more share in the property and petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.41318 of 2018(3) dt.11-07-2018 2/2 the petitioner, namely , Sanjay Mahto, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Samastipur in connection with Sarairanjan P.S.
