The petitioner apprehends his arrest in Adapur P.S. Case No. 61 of 2012, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The mother of the deceased alleged that her son had gone to Sasural but his wife, mother-in-law, father-in-law killed her son. The dead body was also recovered from one of the room of Yogendra Ram, the father-in-law of the deceased. The postmortem report shows that the deceased died due to strangulation. Learned counsel for the petitioners submits that the dead body was brought from in between the house of the petitioner and the deceased. There is absolutely no evidence to show that the
Patna High Court Cr.Misc. No.19321 of 2014 (3) dt.07-05-2015 2/2 petitioners killed Awadhesh Ram.
Considering the facts aforesaid and the fact that there is allegation that the petitioners killed Awadhesh Ram, his dead body was recovered from the house of the petitioners and the cause of death is strangulation, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
