Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 18.3.2017 passed in Cr. Misc. No.7824 of 2017, order dated 7.3.2018 passed in Cr. Misc. No.4620 of 2018 and lastly the same has been rejected vide order dated 28.11.2018 passed in Cr. Misc. No.66583 of 2018 with direction to the learned trial court to expedite the trial considering the fact that the petitioner is in custody for two years and conduct it on day-to-day basis and the S.P., Saharsa was directed to ensure the presence of the witnesses. Submission of the learned counsel for the petitioner is that he is in custody for about two years and up till now the trial has not been concluded as well as he is ready to abide by any condition imposed upon him.
Patna High Court CR. MISC. No.49504 of 2019(2) dt.07-08-2019 2/2 Heard learned A.P.P. as well as the learned counsel for the informant, who has informed this Court that in this case all the witnesses have been examined except the Doctor and he is likely to be examined very soon. .
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to examine the prosecution witnesses within a period of four months without giving any unnecessary adjournment to the accused persons or the State.
With the aforesaid direction, this application is dismissed.
