The present appeal is directed against the order dated 11.11.2020 passed by the Additional Sessions Judge- I, Rohtas at Sasaram in a case registered for the offence punishable under Section 341, 307, 120B, 34 of the IPC, u/s 27 of Arms Act and u/s 3(i)(r)(s)(w) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities)Act, 1989 whereby bail of the appellant has been rejected.
Earlier the regular bail petition of the appellant was rejected vide order dated 03.07.2019 passed in Cr. Appeal (SJ) No. 4935/2019.
A report was called for from the court below and from perusal of the report, it appears that appellant is causing
Patna High Court CR. APP (SJ) No.702 of 2021(3) dt.26-07-2021 2/2 delay in disposal of the trial and the case was fixed for framing of charge on 20.02.2020 but on 20.02.2020 the appellant filed a petition that he wants to prefer a revision against the order passed by this court on 20.02.2020 and thereafter several dates were fixed for framing of charge and to produce the order of this court.
In view of aforesaid facts, it appears that the accused persons are delaying the trial of the case.
Considering the nature of the allegation made against the appellant and the fact that the accused persons are delaying the trial of the case, I am not inclined to enlarge the appellant on bail. This appeal is, accordingly, dismissed. (Prabhat Kumar Singh, J) BKS/- U T
