2. The present application has been filed for cancellation of bail granted to the opposite party no. 02 by a coordinate Bench of this Court vide order dated 17.11.2025 passed in Cr. Misc. No. 79456 of 2025 arising out of Saran Mahila P.S. Case No. 30 of 2025 registered for the offence under Sections 85, 82, 126(2), 351(2), 352, 3(5) of the BNS.

3. Learned counsel for the petitioner has not been able to make out a case for cancellation, however, he submits that Maintenance Case No. 8 of 2019 is pending in the Court of Principal Judge, Family Court, Saran in which the opposite party no. 02 has appeared but the same is not being disposed of

Patna High Court CR. MISC. No.49420 of 2026(2) dt.21-07-2026 2/2 and the petitioner has no source of income.

In view of the above, this application is disposed of with a direction to the Principal Judge, Family Court, Saran to conclude the proceedings of Maintenance Case No. 8 of 2019 within three months from the date of communication of a copy of this order by holding day to day hearing. He is also directed to proceed ex-parte against the non-cooperating party and will send a report to this Court after three months. The concerned Court below is also directed to conclude the trial arising out of Mahila P.S. Case No. 30 of 2025 within six months from today.

5. List this case after three months under the heading "For Orders" for perusal of the report of Principal Judge, Family Court, Saran. It is made clear that if the Court of Principal Judge, Family Court, Saran is vacant then the Principal District and Sessions Judge, Saran will transfer the case to his Court and will proceed accordingly, as per the direction of this Court.

6. Let a copy of this order be communicated to the Principal District and Sessions Judge, Saran through FAX for its compliance.
