The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No. 128 of 2014 registered under Sections 341, 323, 337, 307 and 504/34 of the Indian Penal Code. The accusation is that this petitioner along with his son Shambhu Singh assaulted and abused the driver of the tractor of the informant. When the informant made protest then Dinesh Singh caused injury through spade at the head of the informant. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the occurrence took place due to land dispute and this petitioner is an old man aged about 68 years. It is also submitted that it would appear from the order dated
Patna High Court Cr.Misc. No.47590 of 2014 (2) dt.07-05-2015 31.10.2014 passed in A.B.P. No. 20746 of 2014. Whereunder the prayer for anticipatory bail of the petitioner was rejected by the Sessions Judge, Patna that injuries found on the person of the informant is said to be caused by hard and blunt substance and simple in nature.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City in connection with Gaurichak P.S. Case No. 128 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
