JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Hussainganj ( M.H.Nagar) P.S.Case No. 173 of 2014 registered for the offences punishable under Sections 341, 323, 324, 307, 364, 379/34 of the Indian Penal Code.
Petitioners are said to have mercilessly assaulted the informant by means of lathi and other weapons and it is specifically stated that petitioner no. 3 gave Daab blow to the informant causing injury on his forehead.
Admittedly, only two injuries were found on the person of
Patna High Court Cr.Misc. No.9933 of 2015 (2) dt.12-03-2015 2/2 the injured and both the injuries were simple in nature said to be caused by hard and blunt substance. There is land dispute between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Hussainganj ( M.H.Nagar) P.S.Case No. 173 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
