Petitioner apprehends his arrest in connection with Banka P.S. Case No.720 of 2022 dated 15.11.2022, registered for the offence punishable u/s 366A of the IPC and section 12 of the POCSO Act, pending in the Court of learned Additional Sessions Judge VI cum Spl. Judge, POCSO, Banka. 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application because the police has filed final form but till date cognizance has not been taken by the learned Court below.

Permission is granted.

Accordingly, the instant application is dismissed as

Patna High Court CR. MISC. No.52239 of 2023(4) dt.29-02-2024 2/2 withdrawn.

However, petitioner is at liberty to renew his prayer for anticipatory bail, if cognizance is taken against him by the Court below.
