The petitioners seek bail in connection with Chousa P.S. Case No. 59 of 2018 dated 16.03.2018 instituted for the offences under Sections 461 and 379 of the Indian Penal Code.

A theft was committed in the shop of the informant and several electronic items and peripherals of computer were stolen. The petitioners have not been named in the FIR and during the course of investigation, certain looted articles are stated to have been recovered from the house of the petitioners.

Learned counsel for the petitioners has submitted that those articles have not been put on test identification parade and the petitioners are in custody

Patna High Court Cr.Misc. No.40360 of 2018(2) dt.12-07-2018 2/2 since 23.03.2018.

Though an explanation has been given about the recovery of the aforesaid stolen articles from their houses, but that explanation is not tenable.

Be that as it may, regard being had to the fact that the petitioners do not have any criminal antecedent and are in custody since 23.03.2018, they above named are directed to be released on bail on theirs furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chousa P.S. Case No. 59 of 2018.
