The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120(B) and 307 of the Indian Penal Code and 27 of the Arms Act.
The informant was shot at when suspicion was raised against the petitioner since there was land dispute going between the petitioner and the informant.
It is submitted by learned counsel for the petitioner that after investigation the petitioner was not sent up for trial but differing with final form cognizance was taken by the learned C.J.M., East Champaran at Motihari vide order dated 01.10.2013 under Sections 307 of the I.P.C. and 27 of the Arms Act.

No.5563 of 2015 (2) dt.03-03-2015 2 / 2 Considering the fact that accusation was not found true against the petitioner during investigation, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Motihari Town P.S. Case No. 127 of 2010(T.R. No. 842 of 2013) on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
