Petitioner, already in custody, seeks bail in connection with Jagdishpur P.S. Case No.117 of 2018 registered under Sections 366A, 504 and 506/34 of the Indian Penal Code. Allegation in brief is that one Mithun Kumar and this petitioner kidnapped the minor daughter of the informant and Mithun Kumar said to have brought the girl to Delhi and also indulged in sexually exploiting her.

Learned counsel for the petitioners submits that it is a case of elopement as the informant's daughter was in love affair with Mithun Kumar but allegation in the FIR is that she eloped in day hours on motorcycle and in her statement recorded under Section 164 Cr.P.C., she has not alleged regarding any sexual

Having considered the aforesaid facts and circumstances, petitioner Rahul Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Jagdishpur P.S. Case No.117 of 2018.
