Learned counsel for the petitioners does not press this application against petitioner no. 4, namely Nagendra Baitha. So this application on behalf of petitioner no. 4, stands dismissed as not pressed and are restricted to petitioner nos. 1, 2 and 3 namely, Deepak Baitha, Guddu Baitha and Chandan Baitha, respectively.

The petitioner nos. 1, 2 and 3 seek bail in anticipation of their arrest in connection with Rivilganj P.S. Case No. 144 of 2020 instituted for the offences punishable under Sections 279,

Patna High Court CR. MISC. No.7087 of 2021(4) dt.13-01-2022 2/2 341, 323, 324, 307, 337, 379, 504, 506/34 of the Indian Penal Code.

Considering that there is no specific role assign to petitioner nos. 1, 2 and 3 and taking into consideration the nature of injures, I am inclined to allow the petitioner nos. 1, 2 and 3 namely, Deepak Baitha, Guddu Baitha and Chandan Baitha on bail, in the event of arrest they shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
