Petitioner, already in custody, seeks bail in connection with Brahmpur (Chakki O.P.) P.S. Case No.389 of 2017 (POCSO Case No.08 of 2018), registered under Sections 363 and 366(A) of the Indian Penal Code.

Allegation in brief is that the informant's daughter was enticed away by the petitioner for the purpose of marriage. Learned counsel for the petitioner submits that it is a case of elopement as it is reflected from the statement of the girl and she has not alleged of any physical or sexual assault against the petitioner, moreover the petitioner has been in custody for nine months approximately.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.42711 of 2018(3) dt.27-07-2018 2/2 circumstances, petitioner Pawan Yadav @ Pawan Kumar Yadav @ Sambhu Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-1-cum-Special Court, POCSO Act, Buxar in connection with Brahmpur (Chakki O.P.) P.S. Case No.389 of 2017 (POCSO Case No.08 of 2018).
