Mr.Satyendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-02-2023 Heard learned counsel for the petitioner, informant and learned A.P.P appearing on behalf of the State.

The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is a case of commission of murder of the father of the informant by all the accused persons including the petitioner.

Patna High Court CR. MISC. No.51138 of 2022(3) dt.06-02-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner and the informant are next door neighbours. The occurrence took place on 23.03.2022 but the F.I.R was registered on 24.03.2022. The petitioner is languishing in custody since 24.03.2022.

Learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner and submitted that he shot fire at the victim as a result of which, he received gunshot injuries and died. The Postmortem report and the independent witnesses have also supported the case of the prosecution.

Considering the aforestated facts, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for grant of bail to the petitioner stands rejected.
