Although the nomination of the petitioner has been accepted for the post of Member, Panchayat Samiti but it is the complaint of the petitioner that while he intended to file his nomination from Shahpur(North)Panchayat but it has been accepted for Shahpur(South)Panchayat. Mr. Jharkhandi Upadhyay while making such submissions also informs that the election to the Panchayat Samiti in question has already been taken place on 28.4.2016.

In the circumstances that the election has already been held, no cause for indulgence is made out and the writ petition is accordingly disposed of.

The petitioner if so advised, can take recourse to the remedies available to him under the Bihar Panchayat Raj Act, 2006 and the election rules framed thereunder. Bibhash/- (Jyoti Saran, J) U
