The petitioner seeks bail in Kudhani P.S. Case No. 17 of 2018 registered for the offence punishable under Sections 356, 379, 307, 414/34 of the Indian Penal Code. Informant has alleged in his written complaint that while he was going on motorcycle to deposit Rs. 2,20,000/- in the bank along with his younger brother, three named FIR persons surrounded them and petitioner pointed revolver over the informant and other accused gave knife blow to his younger brother who was pillion rider on the motorcycle and he sustained two minor injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and has been
Patna High Court Cr.Misc. No.40217 of 2018(2) dt.13-07-2018 2/2 dragged in this case on false and frivolous allegation. It has been further submitted that one of the co-accused namely, Raushan Kumar on whom there is specific allegation of causing injury has been granted bail vide order dated 29.06.2018 passed in Criminal Miscellaneous No. 33523 of 2018. Petitioner is in custody since 28.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge 3rd cum Additional Chief Judicial Magistrate 3rd, West Muzaffarpur, in connection with Kudhani P.S. Case No. 17 of 2018.
