The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code and 3(1)(x)(xi) of the SC/ST (Prevention of Atrocities)Act.
It is alleged that the petitioner and two other co-accused entered into the house of the informant in drunken condition and abused him by calling caste name and demanded Rs. 50,000/- as extortion. Petitioner alleged to have assaulted the informant with fists and slaps whereas Luttan Yadav tore the clothes of the informant and co-accused Jitendra Yadav snatched necklace of the informant. Patna High Court Cr.Misc. No.5585 of 2015 (2) dt.03-03-2015 2 / 2 petitioner that F.I.R. was registered on 20.10.2014 whereas the same was received by the learned C.J.M. on 22.10.2014.
The accusation of abusing the informant is omnibus and general. Moreover, the offence under SC/ST has been committed inside the house of the informant which can not be treated to be a place of public view. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Amarpur P.S. Case No. 319 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Banka, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
