JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise P.S. Case No. 942 of 2018 for the offence under Sections 30(A) of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case the petitioner was apprehended by the police only on the basis of suspicion and recovered 14 liters liquor. The learned counsel submits that nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 04.06.2018.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be

Patna High Court Cr.Misc. No.40639 of 2018(2) dt.10-07-2018 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur at Ara, in connection with Excise Case No. 942 of 2018 arising out of Buxar Rail P.S. Case No. 42 of 2018.
