2. It is submitted by learned counsel that despite specific direction of this Court, trial was not concluded within a period of six (06) months. It is also pointed out that only one charge-sheet witness has been examined till date.

3. A report of Trial Court dated 11.09.2023 made available to this Court suggesting that further eight (08) months are required for conclusion of trial. It appears that save and except custody, where petitioner is in custody since 22.08.2021, no substantial change on factual parts surfaced after rejection of the earlier prayer of bail through Cr. Misc. No. 9344 of 2022. In view of the aforesaid facts and circumstances prayer for bail of petitioner on second occasion is also rejected herewith.

4. In view of report of the learned Trial Court i.e., Additional District and Sessions Judge, 1st Barh, Patna, it is directed to conclude the trial, positively, within a period of three

(03) months from the date of receipt of a copy of this order, by taking it on board, on day to day basis, as petitioner is in custody since, 22.08.2021.

5. Senior Superintendent of Police, Patna is directed to ensure presence of remaining prosecution witnesses, as and when directed by learned Trial Court, so as to conclude the trial within the aforesaid time period of three (03) months. (Chandra Shekhar Jha, J.) S.Tripathi/- U T
