The petitioner seeks bail in connection with Vaishali P.S. Case No. 153/2015 dated 20.05.2015 instituted for the offence under Section 379 of the Indian Penal Code. The informant had parked his motorcycle in a temple premises, from where it was stolen. He was informed by local persons that the petitioner was seen moving around the temple. The informant therefore suspected that the petitioner might have stolen his motorcycle.

The learned counsel for the petitioner has submitted that but for this unfounded suspicion, there is no other material against the petitioner. Nothing has been recovered from his possession and he does not have any criminal antecedent.

Considering the aforesaid facts, the petitioner above named e is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in connection with Vaishali P.S. Case No. 153/2015.
