1. Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.
2. The petitioner seeks bail in Jadopur P. S. Case No.124 of 2020 registered for the offences punishable under Section 302/ 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. This is the third attempt of the petitioner to seek bail. The petitioner had moved by filing Cr. Misc. No.39238 of 2021, the same was permitted to be withdrawn by order dated 05.01.2022 and thereafter, the petitioner again moved seeking regular bail vide Cr. Misc. No.59680 of 2022, but the same was also permitted to be withdrawn on 16.11.2022 with a liberty to the petitioner to renew his prayer for bail, in the event, if the
Patna High Court CR. MISC. No.53413 of 2023(2) dt.16-08-2023 2/2 trial is not completed within a period of 18 months from the date of receipt/production of a copy of the order.
4. The learned counsel for the petitioner fairly submits that during pendency of the present application, all the five prosecution witnesses have been examined.
5. The learned counsel for the informant submits that after the prosecution witnesses were examined, the case was fixed for hearing.
6. Considering the submissions of the learned counsel for the informant, the Court is not inclined to release the petitioner on bail.
