2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 115(2), 118(2), 126(2), 109, 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, on the order of petitioner no.2, co-accused Ajit Rai fired gun shot as a result of which informant's son sustained fire arms injury in the stomach.
4. It is submitted on behalf of the petitioners that the specific allegation of firing gun shot is against co-accused Ajit Rai and no specific overt act has been alleged against these petitioners. There is land dispute between the parties and present
Patna High Court CR. MISC. No.49562 of 2025(2) dt.06-08-2025 2/2 case is counter blast of Jurawanpur Police Station Case No. 159 of 2022 filed by Bhabhi of co-accused Ajit Rai against the informant's family members. F.I.R. has been lodged after inordinate delay of ten days without any explanation which renders the entire prosecution case doubtful. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Jurawanpur Police Station Case No. 81 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
