This is an application for regular bail in connection with Ram Krishna Nagar P. S. Case No. 23 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against petitioner is that he along with other accused persons had come to the Mohalla of the informant and fired upon him. Thereafter, he was taken to PMCH for treatment but doctors declared him brought dead. It has been submitted on behalf of the petitioner that he is innocent and is in no way involved in the present case. He has falsely been implicated in the present case due to

Patna High Court Cr.Misc. No.40245 of 2018(2) dt.13-07-2018 2/2 village politics. There is no specific allegation of firing against him. Nothing has been recovered from possession of petitioner. He is in custody since 25.1.2018. It is further submitted that one of the co-accused, namely, Uttam Kumar, has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 38018 of 2018.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned SubJudge-III- cum - Special Judge C.B.I.-II-Patna, Additional Chief Judicial Magistrate, Patna, in connection with Ram Krishna Nagar P. S. Case No. 23 of 2018.
