The petitioner is in custody since 24.03.2018 on his remand in connection with Bennipatti P.S. Case No. 229 of 2017 for the offence registered under Sections 356 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that earlier the petitioner was apprehended in Benipatti P.S. Case No. 241 of 2017 and no sooner he was granted bail by this court in connection with the said case, the petitioner has been remanded in connection with the present case. It is further submitted that the petitioner's complicity in the present case has surfaced on the basis of the confessional statement made before the police by coaccused Kamlesh Kumar which has no evidentiary value. It is further submitted that the said Kamlesh Kumar has also named Chandan Kumar, who has since been extended the privilege of bail
Patna High Court Cr.Misc. No.43230 of 2018 (2) dt.31-07-2018 in Cr. Misc. No. 38319 of 2018 vide order dated 03.07.2018. The petitioner, thus, being similarly situated, may be extended the privilege of bail.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Benipatti in connection with Benipatti P.S. Case No. 229 of 2017. (Anjana Mishra, J) Jagdish/- U T
