2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 188 and 414 of the Indian Penal Code, Sections 8 and 20 of the N.D.P.S. Act and Section 52 of the Prisoners Act, registered in connection with Hajipur Sadar P.S. Case No. 158 of 2024.

3. As per prosecution case, there has been recovery of two mobiles and two data cables from the slipper of the petitioner who was under trial prisoner of Bhagwanpur P.S. Case No. 15 of 2023.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case due to

Patna High Court CR. MISC. No.54446 of 2024(2) dt.12-08-2024 2/2 mala fide intention and has committed no offence. No incriminating article has been recovered from his conscious possession. Petitioner has remanded in this case on 22.05.2024 from another case and since then he is in custody.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 158 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
