JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. 120 liters of country made liquor were recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that recovery is from the joint family house. The FIR was registered on 01.04.2014 when it reached to the court of learned magistrate on 05.04.2014 which reflects that the FIR has been registered by antedating. The seizure list does not bear the signature either of the petitioner or his family member. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.8673 of 2015 (3) dt.24-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna in connection with Shahpur P.S. Case No. 71 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
