2. The petitioner seeks bail in connection with Kudhani P.S. Case No. 457/2023 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

3. The dead body of the Ashutosh Kumar was discovered. The informant has suspected the hands of the petitioner and others. During investigation, it has come that the deceased Ashutosh Kumar was seen going with Deepak Kumar and Amar Kumar on a motorcycle. Though the CCTV has been examined but the same has not been shown to the informant or any any other co-villager to identify the accused. The petitioner is in custody since 18.11.2023 and he has clean antecedent.

4. In these circumstances, learned counsel for the

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also the period of custody, this application is allowed.

7. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st (West), Muzaffarpur /concerned court in connection with Kudhani P.S. Case No. 457/2023, with a condition that he will cooperate in the trial either by personally or through his lawyer in the trial court on each and every date fixed for hearing.
