JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which processes were directed to be issued after cognizance being taken under Sections 323, 504, 379, 354 of the Indian Penal Code.
The prosecution case is that the accused persons came and surrounded the complainant. The petitioner tried to strip the complainant and when husband of complainant came to rescue coaccused, Vijay Pandit, Panchu Pandit and Jalandher Pandit surrounded him and assaulted with fists and slaps and when the villagers came and made protest the petitioner snatched golden chain worth Rs. 50,000/ from the complainant and also took away Rs. 50,000/- cash.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.20246 of 2016 (2) dt.09-05-2016 2/2 that petitioner is agnate of the complainant and on account of petty dispute the accusation has been levelled and the complainant has not received any injury. The father of petitioner filed complaint case No. 3764 of 2013 levelling accusation under sections 341, 323, 379, 307, 504/34 of the IPC against the complainant which was later on registered as police case being Ganga Bridge P.S. case No. 5 of 2014. It is submitted by learned counsel for the petitioner that the petitioner was made accused in three other cases at the behest of the complainant side but out of three in two cases he has already been acquitted and in third case he is on bail.
Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anoop Singh, learned JM, 1st class Vaishali at Hajipur in connection with Complaint Case No. 2084 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
