JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Ghosi Police Station Case No. 205 of 2014 registered for the offences punishable under Sections 341, 323, 325, 307/34 of the Indian Penal Code.
Admittedly, there is a case and counter case between the parties and it is alleged that persons from both the sides sustained injury.
It is obvious from perusal of the first information report, that no specific overt act has been attributed against the petitioner no. 1 whereas petitioner no.2 is said to have caused injury on the
Patna High Court Cr.Misc. No.6994 of 2015 (2) dt.23-02-2015 2/2 right hand of the informant. Annexure-4, the injury report of the informant, reveals that altogether four injuries were found on his person but except one injury which was found on left shoulder, all the injuries are simple in nature.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Ghosi Police Station Case No. 205 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
