====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 31.5.2018, seeks bail in Amnaur PS Case No. 88 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 307, 354, 452, 436 and 504 of the IPC. The allegation in brief is that large number of accused persons came to the house of the informant, Raju Rai, Ajay Rai, Pankaj Rai, Chhota Tuna, Sanoj Rai and Bhim Rai assaulted some of the faily members of the informant Ajay Rai is said to have set fire in the house of Om Prakash Bhagat.

Learned Counsel for the petitioner submits that there is case and counter case between both sides, the accusation of assault is specific only against six persons and there is no specific overt act against the petitioners and they have no criminal antecedent. Having considered the said facts and circumstances, the petitioners, namely, Tuna Rai @ Vakil Rai and Bhisham Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM II Saran at Chapra in connection with Amnaur PS Case No. 88 of 2018.
