JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-08-2019 There is no representation on behalf of the petitioners. The petitioners are seeking a direction to respondent no.2 to pay them amount of compensation against acquisition of their lands, which have been acquired for construction of a road from Digha to Patna City. The petitioners have relied on an order of this Court passed in CWJC No. 21520 of 2013 dated
Patna High Court CWJC No.15672 of 2019(2) dt.01-08-2019 2/2 03.07.2014. According to them, the said order dated 03.07.2014 applies in their case(s) as well.
The order date 03.07.2014 was passed more than five years before filing of the present writ application. The only direction which has been given in the said order is that if the authorities arrive at a conclusion that the land belongs to the petitioners of that case, they should be suitably compensated, in accordance with law.
If the petitioners are in a position to make out a case that their lands have been acquired for the purpose of construction of the said road, they shall be at liberty to claim compensation.
This writ application is disposed of with the above observation.
