====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-08-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103, 238, 61(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, all the F.I.R. named accused persons took away nephew of informant and thereafter his dead body was found lying near the Duthinganj Ghagha road.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused Narendra Singh @ Funtush which has got no evidentiary value in the eye of law. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.50002 of 2025(2) dt.27-08-2025 2/2 the bail application.

Considering the fact that petitioner is not named in the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Bhojpur at Ara in connection with Jagdishpur P. S. Case No. 291 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
