Petitioner apprehends his arrest in connection with Anti P.S.Case No. 45 of 2014 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner and other accused persons is that they have intercepted the son of the informant and there is allegation that two other co-accused persons have fired. Submission of learned counsel for the petitioner is that FIR itself shows that there is some manipulation in the FIR which has been inserted later on. Further submission is that there is no specific allegation attributed against him and other co-accused persons on conclusion of trial have been acquitted.

Patna High Court Cr.Misc. No.40636 of 2018 (2) dt.13-07-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioner is named in the FIR and he has not appeared till date.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
