JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

In view of the prayer made in the writ petition, the writ petition is disposed of with direction to the District Programme Officer (Estb.), Vaishali (Respondent no.3) who shall examine the claim of the petitioner and if it is found that the petitioner was duly appointed and he is working, the respondent no.3 is under obligation to ensure payment of salary to the petitioner within a period of 30 days from the date of receipt/production of a copy of this order.

It is made clear that this court has not expressed any

Patna High Court CWJC No.8572 of 2016 (2) dt.17-01-2018 2/2 opinion on the merit of the case with regard to validity of the appointment of the petitioner and the claim that the petitioner is working, the respondent no.3 is suppose to examine the record and decide the claim of the petitioner within the aforesaid period and in case it is found that the petitioner is entitled to payment of salary, the same may be extended within a period of 30 days from the date of passing of such order.

With the aforesaid, the writ petition stands disposed of.
